Terms of Service
These Terms of Service (“Terms”) govern your use of NCLEX Key (the “Service”), operated by NCLEX Key LLC (“NCLEX Key,” “we,” “our,” or “us”). By creating an account or using the Service, you agree to these Terms. If you don’t agree, don’t use the Service.
1. What NCLEX Key is
NCLEX Key is an online preparation platform for the NCLEX-RN licensure exam. It includes a question bank with rationales (tutor and test modes), Next Generation NCLEX (NGN) item types, unfolding case studies, an adaptive CAT simulator, and performance analytics. It is a study aid — it does not guarantee you will pass the NCLEX. Your actual exam outcome depends on your own effort, preparation, and performance.
NCLEX Key is not affiliated with the National Council of State Boards of Nursing (NCSBN), Pearson VUE, or any nursing regulatory body. “NCLEX” is a registered trademark of the NCSBN, referenced here for descriptive purposes only.
2. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account. You must also be legally capable of entering into a contract in your jurisdiction.
3. Your account
You are responsible for keeping your login credentials secure and for everything that happens under your account. Notify us immediately at support@nclexkey.com if you suspect unauthorized access. One account per person — sharing is not permitted.
4. Pricing, billing, and access
Plans are offered as one-time, non-recurring purchases:
- 1 Month — $59, grants 30 days of access from date of purchase
- 3 Months — $99, grants 90 days
- 6 Months — $149, grants 180 days
Payments are processed by Stripe; we do not store full credit card numbers. No subscription auto-renews; when your access period ends, your account remains but paid features lock until you purchase again. If you purchase while you still have active paid time, the new period stacks on top of your existing expiry.
Prices are in U.S. dollars. Applicable taxes may be added at checkout depending on your location.
5. Pass Guarantee and refunds
Refund terms are fully described in our Refund Policy. In summary: if you’re a first-time NCLEX-RN candidate, complete at least 500 practice questions and finish at least one full CAT simulation above the passing standard before your exam, take the exam during your plan’s active access period, and don’t pass, we’ll refund what you paid after we verify your official NCSBN Candidate Performance Report, which you must submit within 30 days of receiving your result. Refunds revoke your access.
6. Acceptable use
You agree not to:
- Share, sell, republish, or otherwise redistribute our practice questions, rationales, or other content
- Scrape, harvest, or programmatically copy content from the Service
- Resell account access or share your login with others
- Attempt to circumvent security, rate limits, or access controls
- Use the Service to send spam, harass others, or upload illegal content
- Reverse-engineer the CAT algorithm, question pool structure, or our scoring logic
Violation may result in immediate account termination without refund.
7. Intellectual property
All content on NCLEX Key — practice questions, rationales, case studies, illustrations, code, and design — is owned by NCLEX Key LLC or our licensors and is protected by copyright. We grant you a limited, non-exclusive, non-transferable license to access the Service for your personal study while your account is in good standing (paid features only during an active access period). Nothing else is licensed.
If you submit feedback, bug reports, or suggestions, you grant us a perpetual license to use them to improve the Service.
8. Changes to the Service
We add, modify, and remove content regularly. Question banks, case studies, and features may change without notice. We aim for continuous improvement, but do not guarantee any specific feature will remain available.
9. Termination
You can delete your account anytime by emailing us. We can suspend or terminate accounts that violate these Terms. Upon termination, your access ends; your data may be deleted per our Privacy Policy retention rules.
10. Disclaimer
The Service is provided “as is” and “as available.” We don’t guarantee it will be uninterrupted, error-free, or meet every specific need you have. Practice questions approximate the NCLEX format to the best of our ability based on public information and professional judgment; we do not claim exact parity with any given operational NCLEX exam.
Medical and clinical content is for educational purposes only. It is not medical advice, not a substitute for clinical training, and must not be relied on in patient care decisions.
11. Limitation of liability
To the fullest extent permitted by law, NCLEX Key LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost opportunities, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
Some jurisdictions don’t allow certain liability limitations; in those jurisdictions our liability is limited to the minimum extent permitted by law.
12. Indemnification
You agree to indemnify NCLEX Key LLC against any claims, damages, or expenses arising from your misuse of the Service, your violation of these Terms, or your violation of a third party’s rights.
13. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Florida, where NCLEX Key LLC is registered, without regard to conflict-of-law rules. Disputes will be resolved in the courts of Florida, or through binding arbitration at our option, except where local law requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. For material changes, we will email registered users before the changes take effect. Continued use after changes take effect means you accept them.
